不用看完，法官越权了。
在三权体系里面，司法权应该是被动的，因为它首先是独裁的形式和独裁的结果，所以它无论表面形式还是程序执行都应该剔除掉主观诱因，使之不具有进攻性。显然美国司法分支过于主动，且主动追求主动，违反三权分立的初衷。美国的乱以及几乎无法收拾，和司法分支不检点有一定关系。

法官当然是被动的，这次是DOJ主动上诉说遣返法庭法官有问题。
