宪法没有这么说。
1868年内战后，为了给奴隶子女公民身份，第14修正案提出：出生／归化在美国并受美国司法管辖的，享有公民身份。
现在争论的两方的观点是
A. 出生在美国的娃，就是美国公民，不管他父母的身份
B. 美国公民在外国生的娃，受不受美国司法管辖，是不是美国公民？
高院不修改宪法，只是解释宪法。在这个案例，就是要解释14修的适用范围。 修改宪法需要议会和各州公投。

A貌似被解读无数次了，除了外交官员在美国生的小孩，其他人都受到美国的司法管辖，不管合法非法移民，貌似推翻很难。当然这届大法官，当众吃屎的事也做过好几次了，不知道有啥新解读。Trump 写了： 2025年 7月 1日 17:24 宪法没有这么说。

美国宪法第十四修正案明文规定："All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside."
而且，美国最高法院从1898年United States v. Wong Kim Ark的案件判例开始，就一直承认the jus soli principle的。
