「车顶维权」女车主胜诉,特斯拉须提供事完整行车数据,怎样从法律角度解读?拿到行车数据有多重要?
红星资本局9月16日消息 今日,红星资本局从特斯拉(http://TSLA.US)车顶维权车主张女士处获悉,北京市大兴区人民法院就张女士诉特斯拉汽车销售服务(北京)有限公司等买卖合同纠纷一案作出一审判决:责令其在本判决生效十日内,向张女士提供事故前三十分钟的完整行车数据。

此外,张女士还提出其他两项诉讼请求:判令被告承担因其车辆缺陷给原告造成的经济损失人民币2万元(暂定),判令被告承担本案诉讼费用,均被驳回。

法院认定,涉案车辆系智能网联汽车,出现交通事故后,不同于以往的传统汽车,在事故成因上仅需考虑车辆硬件的实时性能即可,智能网联汽车在行驶过程中产生的行车数据对于事故成因分析愈发重要,行车数据对于消费者而言,其重要性和客观需求愈发凸显。

张女士要求提供事故前三十分钟的行车数据,有助于辅助其全面分析涉案车辆该时间段内的整体情况,应当认定为消费者知情权范畴,具备合理性和必要性。

G妞,这件事情的原委是事故发生后特斯拉曾经主动提供数据被车主指责泄露隐私,此后特斯拉更变程序:非法庭判决,特斯拉不提供后台数据。
而这女的赔款500万给特斯拉,一分都没有少。

现在看欧洲是不是立法要求特斯拉必须为事故调查提供数据、至少所有使用FSD 的车子应该 atomically trigger EDR

自己理解能力有问题就别来丢人现眼了。人家写的明明白白,launch的时候只是North America,后来Europe加进来了但是相当于试点,世界上其他任何地方都没有。中国那个完全是因为court order要求他们提供结果没办法了。

Tesla said in a Weibo post that data generated by all cars it sells in China, where it is making Model 3 sedans and Model Y sport-utility vehicles, would be stored in the country.

Last week, Tesla vice president Grace Tao, along with executives at Baidu Inc (9888.HK), opens new tab and Alibaba (9988.HK), opens new tab, attended a policy discussion held by a Chinese think-tank on data security.

asDARTS只是一个available option,并不是Tesla official的program。你看看我贴的那段话最后,还有些reverse engineering的options呢

Tesla official的EDR program现在还只是在北美和欧洲能用。

哦,你也承认后台数据在中国北美欧洲可以合法拿到,甚至主动拿到无须通过特斯拉。
请问,谴责特斯拉封锁数据指控成立还是不成立?

一言难尽,整个事情国内车厂的私利裹挟民族主义,手段太下作了。

19年开始国内大量舆论引导特斯拉刹车失灵,车顶上拉横幅的,加速到200不刹车的
沙子路面刹不住的,自流平车库撞墙的..一波又一波舆论。

特斯拉焦头烂额,主动公布行车数据自证清白,舆论指责公布数据是泄漏隐私国家安全受到威胁,那段时间大大小小的单位停车场禁止特斯拉进入。

特斯拉被逼到墙角:国内行车数据留在国内;行车数据必须有法庭order才能提供

现在,特黑又开始谴责特斯拉不主动公布数据是隐藏数据躲避责任。
