只需要一个案例判决，推翻United States v. Wong Kim Ark就可以了。而且要推翻也不难，只要重新解释啥叫 "subject to the jurisdiction thereof"就行了。像非法移民未经过美国政府批准就进入美国，并且在移民法庭处理他们的庇护申请案例以前，他们都没有被正式授予合法呆在美国的权力，因此从严格意义上讲，他们的入境和停留都不是事先由美国政府批准的，从而 not subject to the jurisdiction of USA government，他们的孩子也就没有出生公民权。sjtuvincent 写了： 2024年 12月 10日 11:29 这么愚蠢过时的政策，早就应该取消了

Wong Kim Ark," the Supreme Court ruled that a child born in the United States to Chinese immigrant parents, even if those parents were not eligible for citizenship, is automatically a U.S. citizen under the Fourteenth Amendment's Citizenship Clause, establishing the principle of birthright citizenship for children born on American soil regardless of their parents' immigration status; essentially confirming that "jus soli" (right of soil) applies to all persons born within the United States borders.
