Why Ireland?
Ireland's appeal as a tax haven stems from its low corporate tax rate of 12.5%, extensive network of tax treaties, and legal provisions that have allowed companies to reduce their effective tax rates significantly. These factors have made Ireland a strategic location for multinational corporations aiming to optimize their tax obligations.
The "Double Irish" and "Dutch Sandwich" Explained
One of the most notable tax avoidance strategies employed by companies like Google and Meta is the "Double Irish with a Dutch Sandwich." This method involves a complex arrangement of subsidiaries and intellectual property (IP) licensing to shift profits to low or no-tax jurisdictions.

How it works:
Irish Subsidiaries: Two Irish companies are established. One holds the IP rights and is tax-resident in a tax haven (e.g., Bermuda), while the other is tax-resident in Ireland and operates the business.
Dutch Entity: A Dutch company is inserted between the two Irish entities. This setup allows the transfer of royalties without incurring withholding taxes, thanks to EU regulations.
The Guardian
Profit Shifting: Profits from global operations are funneled through this structure, with royalties paid to the Irish operating company, then to the Dutch entity, and finally to the Irish holding company in the tax haven. This effectively shifts profits to jurisdictions with little or no taxation.
This strategy enabled companies to significantly reduce their tax bills on non-U.S. profits. For instance, in 2016, Meta (then Facebook) reported €12 billion in Irish revenues but paid only €30 million in Irish taxes.

Phase-Out and Replacement Strategies
Due to international pressure and changes in tax laws, Ireland began phasing out the "Double Irish" structure, with a complete closure by 2020. In response, companies have adopted alternative strategies, such as the Capital Allowances for Intangible Assets (CAIA), allowing them to continue benefiting from Ireland's tax regime by writing off the cost of intangible assets against taxable income.

Global Tax Reforms and Ireland's Position
In 2021, Ireland agreed to a global minimum corporate tax rate of 15% for companies with revenues exceeding €750 million, aligning with OECD-led efforts to curb tax avoidance. Despite this, Ireland remains attractive to multinationals due to its business-friendly environment and tax incentives.

Impact on Ireland's Economy
The strategies employed by companies like Google and Meta have significantly boosted Ireland's corporate tax revenues, contributing to a projected €37.5 billion in 2024, up from €4.6 billion a decade earlier. However, this reliance on a few large multinationals raises concerns about economic stability and the potential impact of future tax policy changes.
